Harvey Weinstein’s rape trial in Los Angeles will move forward in October after a judge denied a bid by his attorneys to delay the case on Monday — but approved the disgraced movie producer’s request to get his missing teeth fixed.

Weinstein’s lawyers asked that the trial be postponed for a few weeks over the release of a feature film about how the sexual abuse allegations against the once-powerful movie mogul were exposed.

“There will be pre-release publicity aimed at ginning up a passionate disdain for Harvey Weinstein,” attorney Mark Werksman told The Post.

He argued the Universal film, “She Said,” — based on the 2019 book of the same name by New York Times journalists Jodi Kantor and Megan Twohey — could stir up negative publicity that would influence prospective jurors.

“This isn’t some indie picture that will quietly vanish from the public scene,” Werksman said about the movie, set to hit theaters on Nov. 18.

The attorney added that Brad Pitt’s involvement as a producer may bring even more attention to the film, and could also prejudice the jury. 

Los Angeles Superior Court Judge Lisa Lench denied Weinstein’s motion to push off the trial, but did agree to look into how she could help the fallen film titan with his dental issues.

“He is missing some teeth and needs some crowns fixed,” Werksman told The Post. “We don’t want him indigent and ill-kept with gaping spaces in his mouth when he goes to trial. When he smiles, you can see he has missing teeth.”

The attorney said he asked for assistance in pushing a request with the LA County Sheriff’s Department to get Weinstein’s teeth fixed and, “The judge said she will do what she can to make sure he gets the care he needs to alleviate the problem.”

In requesting that the case be postponed, Werksman had also argued that the LA trial should not move forward until New York’s highest court decides on Weinstein’s appeal of his 2020 rape and sexual assault conviction in Manhattan.

The Court of Appeals on Friday granted Weinstein’s application for review, finding that “questions of law are involved which ought to be reviewed.” 

“In light of the New York Court of Appeal’s decision to reconsider whether Mr. Weinstein’s case could be reversed, we wanted to postpone his trial here in order to eliminate the horrendous prejudice to him on his trial here in LA,” Werksman said.

Lench said she would consider whether or not information concerning Weinstein’s New York conviction — specifically regarding one of the victims in the case, Miriam “Mimi” Haleyi, — should be entered into the LA trial.

Weinstein, 70, was sentenced to 23 years in prison in March 2020 after a Manhattan jury found him guilty of forcibly performing oral sex on Haleyi, a former “Project Runway” production assistant, in 2006, and of raping hairstylist Jessica Mann in 2013.

He was acquitted of two counts of predatory sexual assault stemming from allegations that he raped actress Annabella Sciorra in the mid-1990s.

Weinstein is now jailed at LA’s Twin Towers Correctional Facility awaiting trial on the separate charges that he sexually assaulted five women in the city between 2004 and 2013. He has pleaded not guilty.

Prosecutors in May filed a motion to include 16 more witnesses who claim Weinstein raped or sexually assaulted them, dating as far back as 1978, including “Splash” actress Daryl Hannah.

After hearing arguments from the defense and prosecution, the judge agreed to allow six out of the 16 additional witnesses.

The LA trial, which will begin on October 10 with jury selection, is expected to take six to eight weeks, Deputy District Attorney Paul Thompson told The Post.
